These Terms & Conditions apply when you access hibana.com.au or purchase products from HIBANA. By using the website or placing an order, you agree to these terms and the policies linked from the website.
Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded or limited.
Website use
You must use the website lawfully and must not interfere with its security or operation, introduce malicious code, scrape the website in a way that damages the Services, impersonate another person, or use content in a way that infringes intellectual property or privacy rights.
Product information and vehicle use
We take reasonable care with descriptions, images, specifications and fitment information. Screen colours and minor production details may vary. Check the complete product listing, vehicle details, dimensions and installation requirements before ordering. Fitment does not by itself establish that a product or installation is lawful for every vehicle or jurisdiction; customers and installers must follow applicable road, vehicle and electrical rules.
Prices and payment
Prices are in Australian dollars unless stated otherwise. The total, including applicable tax, discounts and shipping, is shown at checkout. Payment methods and processing are described in our Payment Policy. If a genuine pricing or listing error occurs, we will contact you before fulfilment and offer the choice to proceed at the correct price or cancel for a full refund.
Orders
An order is an offer to buy. HIBANA accepts it when we send an order confirmation and successfully process payment, subject to stock and verification. We may reasonably limit or cancel an order where supply is unavailable, payment cannot be verified, fraud is suspected, or the order appears intended for unauthorised resale. If we cancel after payment, we will refund the affected amount.
Pre-orders, delivery and returns
Pre-orders are governed by our Pre-Order Policy. Dispatch, tracking and delivery are governed by our Shipping and Delivery Policy. Returns and remedies are governed by our Return & Refund Policy, Fitment Guarantee, Satisfaction Guarantee, voluntary Warranty Policy and the Australian Consumer Law.
Accounts and communications
You are responsible for accurate account and order information and for keeping account credentials secure. Tell us promptly of suspected unauthorised access. Marketing communications are sent in accordance with our Privacy Policy and applicable law and include an unsubscribe method.
Reviews and submitted content
If you submit a review, photo or other content, you confirm you have the right to do so and that it is accurate, lawful and does not infringe another person's rights. You grant HIBANA a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating and promoting HIBANA, subject to applicable privacy law. We may moderate unlawful, misleading, abusive or irrelevant content, but will not suppress genuine reviews merely because they are negative.
Intellectual property
HIBANA's website content, branding, product materials and designs are owned by or licensed to HIBANA and are protected by law. You may view and print content for personal, non-commercial use. Other reproduction, distribution or commercial use requires written permission.
Third-party services and links
The Services may use or link to third-party platforms, payment services, carriers and websites. Their own terms and privacy notices apply to their services. HIBANA is not responsible for independent third-party content, but this does not remove HIBANA's obligations for products or Services it supplies.
Availability and liability
We may maintain, update or temporarily suspend the website. To the extent permitted by law, HIBANA is not liable for loss caused solely by events outside its reasonable control or by unlawful, negligent or incompatible installation or use. Where liability can lawfully be limited, it is limited to the extent permitted by law. Nothing in these terms limits liability for fraud, wilful misconduct, personal injury caused by negligence, or any ACL right or remedy that cannot be limited.
Changes
We may update these terms prospectively by publishing a revised version and date. Changes do not remove rights that accrued under an accepted order before the change.
Governing law
These terms are governed by the laws of South Australia and the Commonwealth of Australia. You may also have rights to bring a claim in another Australian jurisdiction under applicable consumer law.
